3. Where we store your personal data

3.1 The term “Personal Data” in line with the PDPA and the GDPR is defined as including any information relating to an identified or identifiable natural person. An identifiable person is someone who can be identified, directly or indirectly, in particular by reference to an identification number, location data, online identifiers that refer to the person’s physical, physiological, mental, economic, cultural or social identity of the person. Further to the generality of the terms as defined by the PDPA, Personal Data as referred to in this Policy may relate to any natural persons, including BOH Plantations representatives, employees, customers, clients, investors, suppliers, sponsors, contractors or other individuals not specifically mentioned.

3.2 The data that we collect from you may be transferred to, and stored at, a location in Malaysia (server location) or another location inside or outside the European Economic Area (EEA).

3.3 All information you provide to us is stored on our secure servers. Where we have given you (or where you have chosen) a password that enables you to access certain parts of the Site, you are responsible for keeping this password confidential. We ask you not to share any passwords with anyone.

3.4 Sensitive Personal Data is any personal data consisting of information on your physical (racial or ethnic origin) genetic data or biometric data or mental health or condition, political opinions, religious beliefs or other beliefs of a similar nature, the commission or alleged commission of an offence or any such other information prescribed by the PDPA as Sensitive Personal Data.

3.5 It is our express Policy not to collect and process Sensitive Personal Data unless required by any applicable or relevant laws in carrying out specific obligations. You are advised NOT to submit any kind of sensitive personal data if you do not want the BOH to collect or process such data.

3.6 In the event that you have submitted Sensitive Personal Data to us, it will be deemed to have been submitted on your own volition and with your explicit consent. BOH shall treat all Sensitive Personal Data as confidential and such data shall be subject to the terms and conditions of the Policy.

3.7 Unfortunately, the transmission of information via the Internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to the Site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

4. Uses made of the information

4.1 We use information held about you in the following ways:

4.1.1 To ensure that content from the Site is presented in the most effective manner for you and for your computer or mobile device.

4.6.1 From time to time, we would like to use your name, email address, mobile phone number, and other relevant contact information to send you either via emails, SMS messages, telephone calls, push notifications, post, or social media (e.g. Facebook) information that we think may be of interest to you, including about our products and services, satisfaction surveys, events, offers and promotions, but we can only do so with your consent.

4.6.2 You may opt-out from receiving marketing communications at any time, free of charge, by following the unsubscribe instructions contained in the marketing communications or contacting BOH Plantations in accordance with the section “Your Rights” below. 5. Disclosure of your information

5.1 We may disclose your personal information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, who may be inside or outside of Malaysia or the EEA.

5.2 We may disclose your personal information to third parties:

5.2.1 Who help us to administer the Site (such as our Internet service providers) or to provide the services you are requesting. These third parties must at all times provide the same levels of security for your personal information as BOH Plantations.

5.2.5 If BOH Plantations or substantially all of its assets or any member of our group are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.

5.2.6 If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements; or to protect the rights, property, or safety of BOH Plantations or any member of our group, our customers, or others. 5.3.1 In the event of a personal data breach, BOH Plantations shall without undue delay, where feasible not later than 72 hours after having become aware of it, notify the personal data breach to the supervisory authority competent unless the personal data breach is unlikely to affect the rights and freedom of the natural persons.

5.4 Retention of Personal Data

5.4.1 To the extent required by law, we take reasonable steps to destroy, or de-identify or redact, personal data in a secure manner when we no longer need it for the purposes for which it was collected (as set out in this Privacy Policy) and retention is no longer necessary for legal or business purposes.

6.1 Except where required by local laws, we do not knowingly collect personal data from minors. If you are a minor, you may only use our Site and services with the permission of your parent or guardian.
